Terms and Conditions 

1. Introduction

Welcome to MindNest ADHD Clinic

These Terms and Conditions govern the provision of services by the Clinic. By booking an appointment or using our services, you agree to these Terms and Conditions.

2. Scope of Services

The Clinic provides assessment, diagnosis, treatment planning, medication management, and follow-up care relating to neurodiversity and associated conditions.

Services are provided by appropriately qualified healthcare professionals, including General Practitioners, psychiatrists and other clinicians where applicable.

The Clinic does not provide emergency medical services.

3. Appointments

Appointments may be conducted in person, by telephone, or via tele-health where clinically appropriate. Initial and second appointments are face to face only.

Patients are responsible for:

  • Providing accurate and complete information.
  • Attending appointments on time.
  • Informing the Clinic of any changes to contact details or health information.
  • Late arrival may result in a shortened consultation or rescheduling.

4. Fees and Payments

Fees are payable at the time of booking or consultation unless otherwise agreed.

Additional fees may apply for:

  • Reports and letters.
  • Prescription requests outside consultations.
  • Completion of forms.
  • Missed appointments.

Any Medicare, insurance, or third-party rebates remain the patient’s responsibility to claim unless otherwise stated.

5. Cancellation and Non-Attendance

Appointments cancelled with less than 48 hours notice will incur a 50% cancellation fee.

Patients who fail to attend appointments without notice(No-Show) will be charged the full consultation fee.

Repeated missed appointments will result in discharge from the Clinic.

6. ADHD Assessment and Diagnosis

An ADHD diagnosis cannot be guaranteed.

Assessment outcomes are based on:

  • Clinical interviews.
  • Medical history.
  • Screening questionnaires.
  • Collateral information where available.
  • Relevant diagnostic criteria.

The treating psychiatrist/ paediatrician retains sole discretion regarding diagnosis and treatment recommendations.

7. Prescribing and Medication

Prescribing decisions are made solely at the discretion of the treating clinician.

The Clinic does not guarantee:

  • Prescription of stimulant medication.
  • Prescription of any specific medication.
  • Continuation of existing prescriptions obtained elsewhere.

Patients will be required to provide:

  • Previous medical records.
  • Specialist reports with medication /stimulant management plan
  • Drug screening results.
  • Physical health assessments.

Failure to comply with monitoring requirements may affect ongoing prescribing.

8. Referrals and Shared Care

Where appropriate, patients may be referred to specialists, psychologists, psychiatrists, counsellors, or allied health practitioners.

The Clinic may participate in shared-care arrangements; however, such arrangements remain subject to clinical suitability and regulatory requirements.

9. Telehealth Services

Telehealth consultations may not be suitable for all patients.

Patients acknowledge that:

  • Technical issues may affect consultations.
  • Identity verification will be required.
  • Certain assessments may require face-to-face review.
  • Telehealth services are privately billed.
  • Recording is not permitted

The Clinic reserves the right to convert a tele-health appointment to an in-person appointment where clinically necessary.

10. Privacy and Confidentiality

MindNest ADHD Clinic collects, stores, and uses personal and health information in accordance with ‘Privacy and Personal Information Protection Act 1998 (NSW)(PPIP Act) and the Health Records and Information Privacy Act 2002 (NSW)(HRIP Act)

AI and microphone will be used in accordance with strict guidelines set up by AHPRA, using specialised clinical platforms and the eHealth NSW AI Advisory Service for safe AI integration.

Limits of Confidentiality

While confidentiality is a fundamental part of healthcare, there are circumstances where information may need to be disclosed without your consent. These include situations where:

  • There is a serious concern that you may be at risk of harming yourself or another person
  • Disclosure is required by law, court order, or other legal obligation.

Where appropriate and safe to do so, we will discuss any necessary disclosure with you.

11. Patient Responsibilities

Patients agree to:

  • Treat staff respectfully.
  • Provide accurate information.
  • Follow treatment recommendations where appropriate.
  • Use prescribed medications only as directed.

Aggressive, abusive, threatening, or inappropriate behaviour may result in immediate termination of services.

12. Emergencies

The Clinic does not provide emergency services.

If a patient experiences a medical or mental health emergency, they should contact emergency services or attend the nearest emergency department immediately.

13. Limitation of Liability

To the maximum extent permitted by law, the Clinic shall not be liable for any indirect, incidental, or consequential loss arising from the use of its services.

Nothing in these Terms excludes rights that cannot legally be excluded under applicable consumer or healthcare laws.

14. Termination of Care

The Clinic may discontinue providing services where:

  • There has been a breakdown in the therapeutic relationship.
  • Clinical care can no longer be safely provided.
  • Fees remain unpaid.
  • Patients repeatedly fail to attend appointments.
  • There is inappropriate behaviour toward staff.

Reasonable notice will be provided where practicable.

15. Changes to These Terms

The Clinic may update these Terms and Conditions from time to time. The latest version will be available on our website and/or provided upon request.
